7. Ordinance 907 (re-zoning tract west of Memorial on south side of
Hwy 20 from AG to RS-3) was approved after a lengthy discussion by
commissioners (mostly Garrett) and comments from several Copper Mill
residents. The main concern being a worry that the new houses would
be smaller and on smaller lots adversely affecting existing nearby
property values. The addition of the new city sewer line that now
serves that area allows smaller than 1/2 acre lots which was the minimum
before the sewer. It was also noted that it was illegal to pre-condition
a zoning. It was also noted that the commission (after the planning
commission) would have the final say on approving final plats and
specific lots. The builder did indicate a willingness to leave mature
trees and consider other buffering and transitions for adjacent properties.
Commissioner Garrett made a motion to deny the rezoning
but received no second. Commissioners Shafer, Bateman & Francis
voted to approve the rezoning.
